Not likely , check the drain plug for tight n, and the oil lines where they go into the side of the motor . Also check that the filter is tight . None of this stuff needs to be super tight just snug , but you just got it so you have no idea what "they " did . They being previous owners .

For the no shift thing , put it up on the centre stand and pretend your riding it , clutch and shift like you would normally . Is it still stuck in 1st gear ?
