man I'm sorry to hear it, it sux. the horrible fact is that it doesn't matter WHAT your attorney "said". he may have "thought" that you have your rights but unless the charges were dropped or dismissed that simple battery is domestic assault if it was against your spouse.

obviously i'm not a lawyer. and my first advice would be to check with the one you had, and then if you don't like the answer find a better one. the terrifying part is that it may be too late. many states consider simple battery against a spouse to still be domestic assault.

domestic violence is a broader term that covers both felony and mistdemeanor charges IN SOME STATES. like I said, state to state it varies. and the horrible thing is that you live in illinois. a state that is not gun friendly by any stretch of the imagination.

did the JUDGE say that you would retain your rights? if he did then you would have some clout behind your attorneys statements.

your doing the right thing. get a lawyer, check into it....
